Residential strata fire compliance is strictly governed by the Fire Protection Association Australia (FPAA) and requires annual inspections and accredited certification. Moreover, various compliance requirements for each building category are defined by the National Construction Code (NCC), formerly known as the Building Code Australia (BCA).
Fire safety and property compliance must be a key focus for every strata owner and manager. Under the NSW Environmental Planning and Assessment Regulation 2000 and the Building and Development Certifiers Act 2018, all commercial property owners also have a legal responsibility to ensure the safety of residents, tenants, staff and visitors.
As a strata owner or manager, you must maintain essential fire prevention measures as outlined in the legislation and under the Australian Standards AS1851-2021 and local council requirements. You must also meet all compliance requirements, including Annual Fire Safety Statements.
The Australian Building Codes Board recently issued the new NCC 2022, which Australian states and territories will adopt on 1 May 2023.
The NCC code will replace the BCA, and is a complex amendment to the previous BCA. The entire structure and format have changed and significantly influence fire protection compliance.
The new NCC 2022 code is Australia’s primary set of technical design and construction provisions for buildings. It sets the minimum requirement for the safety, health, amenity, accessibility and sustainability of certain buildings.
